1. Area of Validity
All deliveries of the Lene & Stefan König GbR (in the following referred to as "bubble.kid berlin") to consumer as to § 13 BGB (German Civil Code) shall be subject exclusively to the following general terms and conditions (AGB) in the version valid on the day of order. You may access these AGB at any given time under the URL http://www.bubblekid.de/conditions.php. You may print these AGB using the "print"-function of your internetbrowser or save the AGB on your computer.

Terms and conditions of the contract partner shall not be applicable and shall put bubble.kid berlin only under obligation, if bubble.kid berlin expressively agrees to them in writing.

2. Conclusion of contract in electronic business transactions
Purchase-contracts using the bubble.kid berlin online shop under the URL http://www.bubblekid.de shall be concluded as follows:

The presentation of goods in our onlineshop shall not be considered as binding offer, but only as online sales brochure.

If you have found an item you like to purchase, you can click on the respective button and add this item to the shopping cart. You can check the content of your shopping cart anytime by clicking on the shopping cart icon. The aforesaid action will not bind you to a purchase. You can remove the items from your shopping cart using the "delete" button in the shopping cart detail screen at any time. If you want to purchase the items in your shopping cart, please click on the button "checkout". Please follow the screens for your order. Mandatory fields are marked with a *. Your data will be processed using an encrypted connection. Please check your data after entering the information; you can correct the entered information. You can cancel the order procedure anytime by closing the browser-window. On all screens we will provide you with information on how to correct the data you have entered. A binding purchase order requires, that you agree to these general terms and conditions.

You enter into a legally binding offer to purchase if you click on the red button "order", on the last screen of the order procedure.

After ordering you will receive immediately an automatic generated confirmation eMail. In this eMail your order will be listed in detail and you can use the function "print", to print out this confirmation eMail.

This automatic confirmation eMail shall only document, that bubble.kid berlin has received the customers binding offer, whereas it shall not be deemed as binding acceptance of the customers offer.

A binding purchase contract shall not earlier be concluded, as the Customer receives a notice of delivery in a separate eMail, or the ordered goods are delivered. If the Customer uses the option to pick up the items directly at bubble.kid berlin's shop, the contract shall be concluded as the Customer receives a notice of acceptance, which shall replace the notice of delivery in such cases.

If certain items which have been ordered are not listed in the notice of delivery, a binding contract shall not be concluded with regard to these certain items; the same shall apply, if certain items - despite ordered, have not been part of the delivery - if the customer has not earlier received a notice of delivery, and therefore the purchase contract will only be concluded with the delivered items.

The contractual information will be stored on our computer system. You can open and view these General Terms and Conditions anytime under the URL http://www.bubblekid.de/conditions.php. You will receive the data of your order and these General Terms and Conditions via eMail. After processing of your purchase order, you may not be able to access the contractual information over the internet, due to security reasons. You can find the details of your order after ordering and registering your account under "my account".

This internet shop is available in English and German language.

3. Retention of title
Goods delivered, shall remain property of bubble.kid berlin until payment in full.

4. Delivery, product availability
If bubble.kid berlin accepts the order, the shipment will be initiated immediately after acceptance of the order.

If the customer chooses "money order" or direct debit from his account, shipment will not be initiated before the payment is fully credited to bubble.kid berlins account. In such a case bubble.kid berlin cannot make a reservation of the ordered goods until the payment is credited. If delivery will be delayed due to these reasons, for example because the ordered items have been sold in the mean time, and have to be reordered, we will inform you immediately.

If bubble.kid berlin cannot deliver the ordered goods in due time without own fault, because the supplier of bubble.kid berlin is himself in default with his contractual duties to bubble.kid berlin, bubble.kid berlin may have the right to withdraw from the contract with the customer. This withdrawal right shall only exist, if bubble.kid berlin has entered into a contract which its supplier, which is binding, entered into in time, and sufficiently regarding the ordered amounts ("kongruentes Deckungsgeschäft"), and there is no other reason, why bubble.kid berlin shall be liable for the non-delivery. If bubble.kid berlin exercises such a withdrawal right, you will be informed immediately that the ordered item is not available. Payments of the customer shall be refunded immediately.

5. Revocation Instruction according to §§ 312d, 355 German Civil Code (BGB)
Right of Revocation

As consumer you are granted a revocation right according to the German Civil Code (BGB). You may revoke the contract without reasons within two weeks in textual form (for example by letter, fax or eMail) or - if you have received the goods before the end of the revocation rights period - by sending back the delivered goods. The period for the revocation right does not begin earlier than to the receipt of this revocation instruction in textual form, not earlier than the receipt of the goods by the recipient (in the case of repeating deliveries not before the receipt of the first partial-delivery), and not earlier than the fulfilment of our information duties as to § 312c Sec.2 BGB in connection with § 1 Sec.1, 2 and 4 BGB-InfoV and our duties as to § 312e Sec.1 1.Sentence in connection to § 3 BGB-InfoV.. Punctual dispatch suffices to comply with the time limit. The revocation shall be made to:

Consequences of revocation

In the event of an effective revocation, the consideration received by both parties shall be restituted/refunded and any benefits received (e.g. interest) shall be returned. If Customer cannot restitute the performance received, either totally or partly or only in a deteriorated condition, it shall, if applicable, be obliged to render compensation to us. In provision of objects, this shall not apply if the deterioration of the object is exclusively to be put down to an examination by Customer such as it would have been possible in a normal shop. Despite of this, You can avoid the obligation to pay compensation for deterioration caused by being used as intended, by not putting the object into use like an owner and omitting everything that impairs its value.

Goods, capable of sending by parcel shall be returned at our risk. You shall bear the costs of return if the supplied goods correspond to what has been ordered and the price of the goods to be returned does not exceed an amount of 40 Euro or in the event of a higher price, if Customer has not yet paid the consideration or a contractually agreed part payment at the time of the revocation. Otherwise, returns shall be free of charge for You.

Objects not capable of dispatch by parcel shall be collected from Customer. Obligations for payment are to be fulfilled not later than within a 30 days period. The period shall begin for you with sending the revocation or the goods, for us with the receipt of revocation or the goods.

6. Prices / Set-off / Right to retention
All quoted prices include the 19% statutory German Federal VAT. The price includes furthermore all other price components, but not additional costs of shipping and delivery.

If you order from Switzerland and other countries that impose import duties or other costs, please consider that bubble.kid berlin has no influence on the amount of such import duties and costs, or the taxes that have to be paid in such a county. In such a case, please obtain the information regarding the costs of a purchase that will be levies due to the import in your county. These costs will NOT be levied by bubble.kid berlin, and are NOT part of the costs of delivery.

Customer shall only be authorized to set-off a claim that is uncontested or has been finally and non-appealably established.

Customer shall only be authorised to exercise a right of retention to the extent that its counterclaim is based on the same contractual relationship.

7. Presentation on the computer screen and sizes.
All pictures that are used for the online presentation for bubble.kid berlin are examples of the respective item. They are not "lifelike" photos of the item but shall only visualize the item. Due to the different types and sizes of computer screens, particularly colours of the real item can be slightly different to the presentation on your computer screen. Only the description of the item shall be binding.

Please consider that sizes of clothing may vary between different manufactures. Whereas size 92 can be the right size for your child from one manufacturer, size 98 can be the right size from another. If you are not sure, what size you need, please feel free to contact us.

8. Limitation of Liability
bubble.kid berlin shall be fully liable under the terms of the German law for damages of the Customer, which are caused by intentional or gross negligent acts of the bubble.kid berlin or its auxiliary persons (i.e. employees). The same applies to personal injury and damages regulated in the "Produkthaftungsgesetz" (German Product Liability Law).

Furthermore bubble.kid berlins liability is limited - whatever the legal reason may be - to the following, if bubble.kid berlin has not given a certain guarantee:

• For negligent (not gross-negligent) caused damages, bubble.kid berlin is only liable if such damage is caused by the breach of fundamental contractual duties ("Kardinalpflicht"). Fundamental contractual duties are such duties which are essential or make it possible to comply with the agreement and whereas the other contractual party can duly rely upon the party's compliance to such duty. If bubble.kid berlin shall be liable under this clause for negligence, bubble.kid berlins liability shall be limited to the typical, foreseeable damage.
• In such cases, where bubble.kid berlin is liable for (not gross) negligence, the liability for damages caused by delay of performance (“Verzögerungsschaden”) shall be limited to the typical, foreseeable damage, but in maximum to 5% of the total consideration as agreed upon in the particular contract.

The aforesaid limitation of liability shall also apply to the liability of auxiliary persons (i.e. employees) of bubble.kid berlin.

9. Final Provisions
For all controversies out of agreements between bubble.kid berlin and the customer, the laws of the Federal Republic of Germany under exclusion of the UN-Convention on the International Sale of Goods shall be applicable.

If individual provisions of these General Terms and Conditions shall be or become legally invalid, the validity of the remaining provisions in these General Terms and Conditions shall not be affected.

Declaration of protection of individual data:
We will use your user date ("Bestandsdaten") solely for the processing of your orders. All customer data will be stored and processed in accordance to the applicable provisions of the German Federal Data Protection Act ("Bundesdatenschutzgesetz", BDSG) and the German Telemedia Act ("Telemediengesetz", TMG).

Your personal-related data, including your address and eMail-address will not be passed to third parties without your particular - and at any given time revocable - consent. This does not apply to our service-partners that require certain user data to process your orders (for example the transport company and the credit institute or banks that are involved in the processing of the payment). In such cases, the passed on data will be limited to the required minimum.

In any case of conflict, between the English and the German version of the General Terms and conditions, the English version shall be deemed as a translation and the German version shall prevail.
